I'm a US citizen and arrived in PH in July of 2011, my mom is from PH so I got a one year Balikbayan visa on arrival, after staying for one year, I was not paying attention and overstayed that visa by three months and went to immigration and paid 10,000php for my overstay and to convert the visa to a tourist visa + 2500php for an ACR. I was told I could stay up to 17 months on this tourist visa before having to leave, so I have been just renewing this visa every 2 months for 2,800php. Late last year I decided to try and get a dual citizenship since my mom was from PH and I was tired of going to immigration often. In October I went to immigration to do my final extension of the 17 months tourist visa and find out about getting dual citizenship, this time while trying to do the extension I was told since it was the last one of the 17 month stay I have to file a petition to get approved for the final 2 months and submit an affidavit, financial info and a few other things along with paying a 6k+php. I paid the fee and got the documents that needed to be filled out to bring back from my petition for approval, next I went upstairs to talk do the guy about filing my dual citizenship. Guy said I had all the needed documents I just need my moms birth certificate and to pay a 10,000php fee to file, he also told me since I will be getting dual citizenship I should not keep renewing my visa(he said I basically paid the 6k for no reason) and do not need to leave the country since you can't leave the country while filing for dual status and that when I get approved for dual status all overstay charges are voided since I become a citizen. I never went back to give the papers for my petition to extend until December that I paid for cause I already started work on getting my dual status, so the past few months i have been trying to get my moms birth certificate from NSO only to find out it is impossible because her birth record was prewar(before 1945) and they won't give me a certificate of no record which I could use in leiu of the actually certificate because her brother mistakenly filing a late birth certificate registration in like 2010 using the wrong date, her birth date, so if you search the date his record comes up and it conflicts with her real birth date, and I can't get him to fix the date because he was in Leyte during the typhoon and no one has heard from him, we assume he is dead. So basically I can't get my dual status because I can't get a birth certificate because her brother filed using her birth date and is now probably dead and am now on a 5+ month over stay. I'm getting married to my British gf this month here in PH because her parents live here and because of finances won't be able to go back to the US till June, I don't even know what my total overstay will be cause I never brought back those papers to extend until December even though I paid the 6k fee, so I'm looking at a possible 8 month overstay if I leave in June, plus the ACR expired in October and I don't know if my ACR has to be valid to leave?. I don't even know where to start, do I book a ticket now for June then go pay the fees right before I try and leave in June? I can't go pay the fees now, because I have to wait till June to fly back and they won't give me 2 months to leave after paying my overstay. What kind of fees will I be looking at? How long do I have after paying my overstay fees before I have to leave? A day or two I assume. Any help would be appreciated. Thanks.
